Georgia Just Criminalized Abortion. Women Who Terminate Pregnancies Would Receive Life in Prison

    On Tuesday, Georgia Republican Gov. Brian Kemp signed a “fetal heartbeat” bill that seeks to outlaw abortion after about six weeks. The measure, HB 481, is the most extreme abortion ban in the country—not just because it would impose severe limitations on women’s reproductive rights, but also because it would subject women who get illegal abortions to life imprisonment and the death penalty.

    The primary purpose of HB 481 is to prohibit doctors from terminating any pregnancy after they can detect “embryonic or fetal cardiac activity,” which typically occurs at six weeks’ gestation. But the bill does far more than that. In one sweeping provision, it declares that “unborn children are a class of living, distinct person” that deserves “full legal recognition.” Thus, Georgia law must “recognize unborn children as natural persons”—not just for the purposes of abortion, but as a legal rule.

    This radical revision of Georgia law is quite deliberate: The bill confirms that fetuses “shall be included in population based determinations” from now on, because they are legally humans, and residents of the state. But it is not clear whether the bill’s drafters contemplated the more dramatic consequences of granting legal personhood to fetuses. For instance, as Georgia appellate attorney Andrew Fleischman has pointed out, the moment this bill takes effect on Jan. 1, 2020, the state will be illegally holding thousands of citizens in jail without bond. That’s because, under HB 481, pregnant inmates’ fetuses have independent rights—including the right to due process. Can a juvenile attorney represent an inmate’s fetus and demand its release? If not, why? It is an egregious due process violation to punish one human for the crimes of another. If an inmate’s fetus is a human, how can Georgia lawfully detain it for a crime it did not commit?

    Doesn’t federal law trump state law. I’m not sure if the federal law but Roe v Wade is precedent and says woman can have abortions. I laugh every time I drive by planned parenthood. I can’t believe people spend their time off protesting like that. I’ve become more antiabortion in these past couple of years. At least to a certain point where a child could live outside of the womb. I understand cases where the woman’s life is in danger, or rape. I guess I don’t care what other people do, it’s not my body, I just don’t agree. I’d be bummed someday if I found out my daughter had one. Not to where I’d be mad, but just bummed. I also really look forward to grand kids.

    Question for you lawyers. If a drunk guy crashes into a pregnant lady, and kills them, can that guy be charged with two counts of manslaughter?

    I also don’t like that people with Down’s syndrome are being aborted. I think I saw something where one European country is having pretty much no people with Down’s syndrome anymore b/c they are being aborted. I’m a former sped teacher with experience with having people with Down’s syndrome. I’ve taught some of the most beautiful people you have ever met. People that can read and write. I had one girl that pretty much put a permanent smile on my face everyday. Every day she’d show up with the biggest smile and say, “I’m here for writing.” She was a beautiful human being.

    And yes, the Unborn Victims of Violence Act establishes the embryo as a legal victim. Apparently, unless it’s the own mother that kills it.

    some people don't want to have the burden of having to care for someone with Down’s syndrome their whole life. when you have a child u do expect them to grow up and move out one day and be independent, but with Down’s syndrome, the parents have to provide for that person their whole life, i can see why people want to abort a child with special needs.

    federal law does override state laws but the courts didn't rule on each states particular law when it comes to abortion but if a state overreaches a case can be sent to the SCOTUS and this may happen with this bill and the ohio one, the problem is if PP or the ACLU brings a case to the supreme court they may just strike down Roe v Wade altogether or make it totally illegal or strike down the federal law allowing abortion and send it back to the states to make whatever law they want to make. red states would probably have a outright ban and women would have to travel to a blue state.
    Kennedy is gone now he was a moderate that kept abortion legal but now the court is further right so Roe v Wade's day might be numbered.

    @ATJ-Lucko not always true about taking care of Downs people for life. Most cases yes, but I know people with Downs who have jobs and live in supported living environments. I was a community skills specialist for a year. You’d have to live in a city for these services. People move to my city for these types of services.

    I’m not saying I don’t see your point. It just goes against who I am. One of my best friends growing up had an intellectual and developmental disability and then I spent 12 years in special education.

    Nah you don’t know me very well then. I’m not soft, I value LIFE. I also know some people who have kids that have Down syndrome. I have a friend who has a brother with Down syndrome and the kid is amazing. He is one of the nicest most lovable people I have ever come across. Probably because he does not look at people with disabilities like himself as if they don’t deserve to exist because of this disability. Don’t come at me with that getting soft in my old age shit when you don’t know me for shit. I value life and I always have worked as hard as I can to help less fortunate than myself, in any way I can. I have two children who do not have any disabilities and I am thankful for their sake. Just disgusted how you seem to think. It’s not even about the abortion issue, it’s about your bullshit attempt of acting like you know what the fuck you are talking about. Don’t take me being passionate about something as life as being fucking soft.
